Terms and conditions
These terms cover the Outgym app for iPhone and this website. They are written to be read. Where the law gives you rights that these terms cannot limit, the law wins.
The short version
- Outgym is a training aid. It is not a medical device, a doctor or a physiotherapist. You train at your own risk.
- Its numbers are measurements and estimates made from a camera picture. They are useful; they are not laboratory results.
- Subscriptions are billed by Apple, renew automatically, and are cancelled in your Apple Account settings.
- Your videos are yours. What you post, and who is in it, is your responsibility.
The agreement
Outgym is provided by [LEGAL NAME OF THE PUBLISHER, COUNTRY] ("we", "us"). By installing or using the app you agree to these terms and to our privacy policy. If you do not agree, do not use the app. You must be old enough to enter a contract where you live, or have a parent's or guardian's permission.
Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as allowed by the App Store's usage rules. The app is licensed to you, not sold.
Training safely
- Exercise carries a risk of injury. Talk to a doctor before starting or changing a training programme, especially if you are pregnant, have a heart, joint or back condition, have been injured, or have been inactive.
- Stop if you feel pain, dizziness, chest discomfort or shortness of breath, and get medical help.
- The app's cues, drills and standards are general coaching guidance. They are not medical advice, a diagnosis or treatment, and they cannot see everything a coach in the room would see.
- You choose your own range of motion in the app. Choosing it, and training within what is safe for your body, is your decision.
- Set your phone and your equipment up safely. Make sure the phone cannot fall, that bars and benches are secure, that you have room to move, and that loaded barbell lifts are done with appropriate safety equipment or a spotter.
What the numbers are
Outgym counts and measures from a camera picture. Results depend on the camera angle, distance, light, clothing and how much of your body is visible. Distances are scaled from the height you enter. Energy, power, estimated one-rep max and muscle heat are model estimates and are labelled as such; muscle heat illustrates published research and does not measure your muscles. Do not rely on the app's output for medical decisions, for competition judging, or where a wrong number could cause harm.
Subscriptions and purchases
- Some features may require a subscription or a one-time purchase ("Outgym Pro"). The price, the billing period and any free trial are shown in the app before you buy.
- Payment is charged to your Apple Account when you confirm the purchase. We use RevenueCat to record what you bought and unlock it; we never see your payment details.
- Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
- You manage and cancel subscriptions in your Apple Account settings (Settings › your name › Subscriptions). Deleting the app does not cancel a subscription.
- Any unused part of a free trial is forfeited when you buy a subscription.
- Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com. Consumer laws in your country may give you additional rights, including a right to withdraw, which these terms do not limit.
- We may change prices for future periods. Apple will tell you in advance, and you can cancel before the new price applies.
- Features that are free today may become part of Outgym Pro later, and the other way round. We will not take away something you have already paid for during the period you paid for.
Your videos
Recordings and analysis videos are made and stored on your iPhone and belong to you. We receive no copy and claim no rights in them. When you share a video, you are responsible for where it goes, for having the agreement of anyone else who appears in it, and for following the rules of the service you post it to. Shared videos may carry the Outgym name.
Fair use
Please do not: copy, resell or rent the app; reverse engineer it except where the law expressly allows; remove its notices; use it to film people without their knowledge or where filming is not allowed; use it to break the law; or present its results as official or certified judging.
What is ours
The app, its design, its exercise standards and coaching text, the Outgym name and logo, and this website belong to us or our licensors and are protected by intellectual property laws. If you send us feedback or ideas, we may use them without owing you anything.
Other companies' services
The app relies on services from Apple (the App Store, on-device frameworks, Photos), RevenueCat (purchase management) and Google (anonymous usage statistics). Their own terms and privacy policies apply to their services. We are not responsible for services we do not control, including the places you choose to post your videos.
Warranty and liability
We work to make Outgym accurate and reliable, but it is provided "as is" and "as available". To the extent the law allows, we make no promise that it will be uninterrupted, error-free, or fit for a particular purpose.
To the extent the law allows, we are not liable for indirect or consequential loss, or for injury or damage arising from your training, your equipment, or your reliance on the app's output. Our total liability for any claim is limited to the amount you paid us for the app in the twelve months before the claim, or 50 euros if that is more.
Nothing in these terms excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection rules.
Ending and changes
You can stop at any time by deleting the app (cancel any subscription first). We may suspend or end your licence if you seriously break these terms. We may change the app and these terms; when a change matters, we will update the date above and tell you in the app. If you keep using the app after a change takes effect, you accept it.
Apple's terms
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claim relating to it, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation. You confirm that you are not in a country under a US government embargo and are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Law
These terms are governed by the laws of [COUNTRY OR STATE], and its courts have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings there. If a part of these terms is found invalid, the rest continues to apply.
